Proper and Timely Notice of Rent Increase

There are a lot of working components to a proper and timely notice of a rent increase. The two main components are the actual amount of the rent increase, and the other may be additional information about the unit. Some cities, like the City of Santa Monica, have detailed stipulations as to how the rent increase calculation must be presented within the notice and other information as well. Below are the stipulations for a proper rent increase notice for each city.

All notices of a rent increase must be given to the tenant 30 days before the new, higher rent price, legally becomes effective, unless:

The property is under the Tenant Protection Act of 2019 (TPA of 2012) and the tenant has resided in the unit less than 12 months, or if one of at least two tenants have not resided in the unit at least 24 months if the other tenant has resided in the unit less than twelve months, then the rent may be increased to any amount decided by the landlord, but if increase amount is more than 10% of the most recent paid rent price, then a 90 day notice of such a rent increase is mandatory. Said differently, if one tenant has resided in the unit less than 12 months, and at least one other tenant has not resided in the unit at least 24 months, then a rent increase of over 10% of the most recently paid rent price is allowed as long as the tenant is provided with a 90 day notice of such a rent increase.

While most ordinances allow for only one rent increase per year, with the City of Santa Monica having even more complex stipulations around a yearly rent increase, the TPA of 2019 allows for two rent increases per year as long as they add up to either CPI + 5% or 10% ,whichever is lower, given that the tenant(s) satisfied the 12 month minimum time of occupancy or at least one tenants has by residing in the unit for 24 months if the other(s) have resided in the same unit less than 12 months.
