The Los Angeles Municipal Code, specific to the City of Los Angeles only, contains ordinances that are of importance specifically to City of LA tenants. These ordinances address various aspects of tenant-landlord relations and housing regulations within the city. The most tenant-relevant chapters within the Los Angeles Municipal Code are Chapters IV, XV, and XVI.

Please note: The Los Angeles Municipal Code governs regulations specific to the City of Los Angeles, yet not all buildings within the city limits fall under its rent increase guidelines. Instead, some buildings default to the Tenant Protection Act of 2019 (TPA of 2019). Additionally, buildings constructed after 2005 are not subject to any rent control measures. Chapter XV - Rent Stabilization Ordinance

In order to ensure fair and safe housing practices and to protect the rights of tenants and property owners alike, the City of Los Angeles has implemented a comprehensive set of laws and programs. These initiatives are designed to address various aspects of rental housing, from rent stabilization to habitability standards and property management practices. Below are brief introductions to each of these laws and programs:

  1. Rent Stabilization Ordinance: The Rent Stabilization Ordinance (RSO) is a crucial component of the City of Los Angeles' efforts to maintain affordable housing options for residents. This ordinance regulates rent increases for certain residential rental units within the city, providing stability and protections for tenants while allowing property owners a more than fair return on their investment, even though they like to act like this is not the case -  their $3 M weddings and $500 per plate outings point to a different story than that which they tell our council members.

  2. Tenant Habitability Program: The Tenant Habitability Program (THP) is dedicated to ensuring that rental units in Los Angeles meet basic habitability standards. Through inspections and enforcement efforts (only if you get a 2 Day Order to Comply), the THP aims to address health and safety concerns in rental properties, thereby safeguarding the well-being of tenants.

  3. Habitability Enforcement Program: The Habitability Enforcement Program focuses on enforcing compliance with housing codes and standards to ensure that rental properties in Los Angeles are safe and habitable for tenants. This program works to identify and address violations through inspections, citations (we can wish), and enforcement actions (only if the landlord finally gets a 2 Day Order to Comply).

  4. Property Management Training Program: The Property Management Training Program provides education and resources to property owners and managers in Los Angeles to promote responsible property management practices (LOL). By offering training on legal requirements, tenant relations (LOL), maintenance standards, and other relevant topics, this program aims to improve the quality of rental housing. It has unfortuanately failed a lot of the time, and so we have to see to this ourselves through organizing!

  5. Utility Maintenance Program: The Utility Maintenance Program is designed to address issues related to utility services in rental properties, including water, gas, and electricity. By ensuring that utilities are properly maintained and functioning, this program helps to enhance the safety, comfort, and livability of rental units for tenants. Chapter IV - Public Welfare

Within the Los Angeles Municipal Code, Chapter IV addresses matters related to public welfare. Particularly pertinent to tenants' rights and protections are several articles within this chapter. These regulations are designed to ensure fair treatment, safety, and stability for tenants within the city. Here's a focused introduction to these articles:

As it pertains to tenants, key articles within Chapter IV include:

  1. Tenant Anti-Harassment Ordinance (Article 5.3): This article specifically addresses regulations aimed at preventing harassment of tenants by landlords or property owners. It outlines provisions to safeguard tenants' rights and well-being within the rental housing market, ensuring they are not subjected to harassment, intimidation, or retaliation.

  2. Prohibition Against Harassment and Retaliation in Housing Based on Immigration or Citizenship Status (Article 5.4): Regulations within this article prohibit harassment and retaliation against individuals in housing based on their immigration or citizenship status. This is particularly relevant to tenants who may be vulnerable to discrimination or mistreatment due to their immigration status.

  3. Prohibition Against Discrimination in Housing Based on Age (Article 5.5): This article establishes protections against discrimination in housing based on age. It ensures that tenants of all ages have equal access to housing opportunities and are not unfairly denied housing based on their age.

  4. Prohibition Against Discrimination Based on Student Status (Article 5.6): Regulations within this article prohibit discrimination in housing based on student status. This is important for tenants who are students, ensuring they are not unfairly denied housing opportunities or subjected to discriminatory practices based on their status as students.

Chapter XVI - Housing Regulations

Chapter XVI of the Los Angeles Municipal Code encompasses a comprehensive set of housing regulations aimed at safeguarding the rights and well-being of tenants and properties within the City of Los Angeles. These regulations cover various aspects of housing, from ensuring the safety and habitability of rental units to addressing issues related to tenant relocation, foreclosure, and eviction. Below is an overview of each article within this chapter:

  1. Housing Code: The Housing Code establishes standards and requirements for the maintenance, occupancy, and safety of residential buildings and dwelling units within the city. It sets forth provisions to ensure that rental properties meet minimum habitability standards and comply with health, safety, and building codes.

  2. Rent Escrow Account Program: The Rent Escrow Account Program provides a mechanism for tenants to address unresolved maintenance issues in their rental units. Under this program, tenants can deposit their rent into an escrow account if their landlord fails to make necessary repairs after receiving notice. The program aims to incentivize landlords to address maintenance concerns promptly and ensure that tenants have safe and habitable living conditions.

  3. Tenant Relocation Assistance Program: The Tenant Relocation Assistance Program provides support and assistance to tenants who are displaced due to certain circumstances, such as eviction, demolition, or conversion of their rental units. This program helps affected tenants find alternative housing and provides financial assistance to mitigate the impact of displacement.

  4. Foreclosure Registry Program: The Foreclosure Registry Program requires property owners to register residential properties in foreclosure with the city. This program aims to track foreclosed properties, identify responsible parties, and ensure that they are properly maintained to prevent blight and deterioration in affected neighborhoods.

  5. Just Cause for Eviction Ordinance: The Just Cause for Eviction Ordinance establishes criteria and procedures that landlords must follow when seeking to evict tenants from rental properties. It protects tenants from arbitrary or unjust evictions by requiring landlords to have valid reasons, or "just cause," for terminating tenancy agreements.
